Opening of an Account

When setting up your Account, it is mandatory to provide precise and complete details including your full name, birthdate, residential address, email, and personal contact number. These details should be kept current.

Providing false personal details, knowingly or unknowingly, especially regarding age, can lead to immediate account closure and the forfeiture or withholding of payments.

4. Contact Details Verification:
You are responsible for providing a legitimate email and phone number. Lottery Stupore might authenticate your contact details via a validation link to your email or an SMS to your phone. Failure to verify might result in account suspension.

6. Account Security:
Upon account creation, you'll be designated a username derived from your email and will be prompted to select a password. You hold sole responsibility for all activities on your Account. It is crucial to safeguard your login details, email, computer, and any device with access to your Account. We recommend logging out post-gaming sessions and ensuring your computer remains attended when logged in. Immediately inform Lottery Stupore of any security breach or unauthorized account access. Bets placed using your details are presumed to be placed by you.

7. Account Restrictions:
Individuals associated with Lottery Stupore or any of its affiliates, those linked with the administration or execution of a Lottery Draw, including Lottery Operators and their employees, immediate family members of the aforementioned individuals, or residents of Prohibited Jurisdictions (USA, Israel, Canada, Iran, North Korea or any country restricting services akin to our Services) or individuals listed under sanctions by the European Union, United Nations National Security Council, or Maltese Sanctions Monitoring Board are barred from opening an Account or continuing to use any Services.

8. Prohibited Jurisdictions:
Lottery Stupore reserves the right to modify the list of Prohibited Jurisdictions as needed.

Management of the Account

Lotto Direct oversees Player Accounts, determining available, pending, betting funds, and winnings. Unless contested, these figures are deemed accurate.

Account Limitations:

  • Each player may only open and maintain one active account.

  • Deposits and withdrawals must comply with Sections 7 and 8.

  • Selling, transferring, or acquiring accounts from other players and transferring funds between accounts is forbidden.

  • Accounts do not accrue interest, and Lotto Direct is not a financial institution.

Lotto Direct's Rights:

  • We can deny account creation, close existing accounts, or decline deposits without giving reasons.

  • We may request documents to verify your identity, other personal details, and payment methods.

  • We can suspend, limit, or forfeit funds if you violate these Terms or engage in illegal or unauthorized activities.

  • We may monitor your gameplay and transactions, verify unused funds, and require additional information for Anti-Money Laundering or Terrorism Funding compliance, especially if deposits exceed €2,000 within 180 days.

Inactive Accounts:

  • An account is inactive if there's no activity for twelve consecutive months.

  • Before inactivity, we'll notify you 30 days in advance via your registered email.

  • Inactive accounts will incur a monthly fee of €2.50, deducted only if the account has credit.

Note: Refunds of fees may be available based on regulations.

Transfers of Funds to your Account - Deposits

  1. Deposit Methods: You can deposit funds using available methods detailed in the Banking section on our Site. Online deposits are initiated by selecting the "Deposit" button. Lotto Direct doesn't charge deposit handling fees.

  2. Credit Card Usage: If you choose to transact on the Site with your credit card or your Account lacks funds for a transaction, you authorize Lotto Direct to charge that or any designated card in your Account.

  3. Subscription Service: For recurring Orders, we may collect payments using your chosen method, including credit cards. We may store your card details and submit charges without seeking further approval, until you cancel this arrangement.

  4. User Agreements:

    • Provide only valid credit card and billing details.

    • We might utilize third-party services for transaction processes.

    • You're responsible for any card issuer fees.

    • Orders are final, non-cancellable, and non-refundable, unless stated.

    • If we don't receive payment, you're obligated to settle all amounts due, including any potential rejected payment fees.

    • Lotto Direct's inability to process a payment doesn't absolve you of payment duties.

  5. Payment Method Changes: We can modify or set conditions for payment methods without notice. Not all payment methods are always available.

  6. Refund Policy:

    • Payments to Lottery purchases are generally non-refundable.

    • If you believe an incorrect charge occurred, you can request a refund through your Account or our Support Service with detailed transaction info. If we find a wrongful charge, your sole remedy is a refund.

  7. Anti-Money Laundering: Lotto Direct rejects funds suspected to be from unlawful sources. All transactions undergo checks to counter money laundering. Suspicious transactions will be reported to authorities.

Terms of Service

  1. Participation in Lottery Draws: Lottery Draws and Lottery Raffle Draws are managed by their respective operators. By placing an order on our Site, you commit to understanding and adhering to these Lottery Operator Rules.

  9. Using the Messenger Service: To participate, users must select their lottery type, input numbers or choose a Syndicate/Lottery Raffle Ticket, complete their order, and pay the required amount.

  10. Syndicate Play Service: Users can buy shares in potential winnings from a set of Lottery Tickets. However, users cannot select Syndicate members. Key points:

  11. Shares represent a portion of potential winnings.

  12. Total available shares, ticket numbers, and combination lines are determined by us.

  13. Details about the shares and combination lines are displayed on the Site.

  14. Users don't own specific tickets but a share of potential winnings.

  15. Lottery Raffle Ticket Service: This service allows purchase shares in global Lottery Raffle Draws. Key specifics:

  17. Winning details are based on Lottery Raffle Operator decisions.

  18. Prize allocation is proportional to the purchased shares. Unpurchased shares revert to the Raffle Operator.

  19. Availability Constraints: Syndicate Play and Lottery Raffle Ticket Services might not combine with other Site features or services.

  20. Order Price Details: The price displayed during order submission:

  26. b. Pending Payments: In case of a payment delay, the transaction status remains pending until we receive the Order Price.

  28. We stop accepting orders for the Lottery Ticket Service and Syndicate Play Service hours before the related Lottery Draw's Cut-Off Time, which is displayed on the site. Post the Cut-Off Time, orders can't be placed. We retain the discretion to set the Cut-Off Time.

  29. Lottery Ticket Purchase:

  30. After receiving your Order and payment, a Local Representative will buy the Lottery Ticket on your behalf. Tickets are purchased quickly post order submission, making them non-refundable. If any discrepancies arise between Order and Ticket numbers, the latter prevails.

  31. Ticket Visualization:

  32. You can view scanned Lottery Tickets in Your Account. We reserve the right to display a graphic representation instead of the actual ticket to avoid misuse.

  45. Media Obligation:

  46. For Prizes > US$ 100,000, we may require the winner to attend a media event.

  47. Travel Responsibilities:

  48. Non-residents may need to travel to collect certain prizes. Travel costs, visas, insurance, and any related expenses are your responsibility unless otherwise stated.

  49. Reimbursement of Travel:

  50. If your prize exceeds specific amounts and you must travel from outside the Territory, we may cover justified travel expenses, possibly in exchange for marketing-related activities.

  60. Your default Lottery numbers during your subscription are based on the initial numbers you specify upon joining the Subscription Service ("Subscription Order Numbers").

  63. Your subscription remains active until you decide to pause or terminate it using the Site Tools. You can also reactivate your subscription anytime.

  64. As a subscriber, you will be charged the Order Price for each participated Lottery Draw.

  65. If you opt to halt or terminate your subscription, charges may still apply for the impending Lottery Draw due to our early purchase approach.

  66. 5. Pricing Acknowledgment:

  67. The Order Price for draws can vary due to reasons such as daily currency fluctuations, Lottery Operator pricing changes, or amendments in our service fees.

  68. 6. Payment:

  69. For your Subscription Service, your Account will be automatically debited.

  70. If insufficient funds are detected in your Account:

  71. We will charge your designated payment method (e.g., credit card) and you grant us permission to do so.

  72. Or, if the purchase can't be made, you'll receive an email notification highlighting the insufficient funds issue.

At its sole discretion, Lottery Stupore can terminate your access to the Site at any time, particularly for any breach of these Terms. Lottery Stupore will not be held responsible to you or any third party for the termination of your access. If you disagree with any term or modification thereof, or if you are dissatisfied with the Site, your only option is to stop using the Site immediately. After these Terms end, you must stop all use of the Site. The provisions of this section (Term and Termination), along with sections on Terms of Service, Intellectual Property Rights, Warranty Disclaimers, and Limitation of Liability, and any other section that should logically persist, will continue after the termination of these Terms.

Assignment

  1. You may not transfer or assign these Terms or any rights and licenses granted under them. However, Lottery Stupore can assign them without any limitations or needing to inform you.

Applicable Law and Jurisdiction

  1. Lottery Stupore may alter or cease any aspect of the Site as desired. The relationship between you and Lottery Stupore is governed by the laws of Malta, without considering any conflicting legal principles. You give up the right to jury trial and class action participation. The UN Convention on the International Sale of Goods doesn't apply here. These Terms represent the entire agreement about the Site between you and Lottery Stupore. Should any provision be invalidated by a competent court, the rest will still stand. No waiver of any term means a continuous waiver or any other term waiver. Not asserting any right or provision under these Terms isn’t a waiver. This online service and website are owned by Lottery Stupore, in accordance with the law, holding copyright and trademark rights. You may use Lottery Stupore under the conditions stated in these terms and any future modifications thereof (hereinafter referred to as "Terms of Use" or "this Agreement"). Using this site implies your acceptance of these Terms of Use. If you do not agree with the Terms of Use, please close the site immediately and refrain from setting up an account or using this site. To use this service, you must be an adult aged 19 or older. Minors under this age are prohibited from using this service. Additionally, users must be of legal age as per the laws of their respective countries.

Article 1 (Purpose) These Terms of Use (hereinafter referred to as 'Terms') are intended to define the rights, duties, and responsibilities of the members (hereinafter referred to as 'members') when they join and use the Lottery Stupore service for purchasing American lotteries, including the 6/45 game and considering Korean tax implications. Lottery Stupore can access personal and registration information provided by members during the sign-up process. This is intended to facilitate the efficient provision of services by Lottery Stupore.

  2. Member: An individual who agrees to these terms and services and benefits from the various services provided by Lottery Stupore.

  3. Smartphone Number ID: The mobile phone number specified by a user to identify and access services (referred to as "ID").

  4. Password: A combination of characters and numbers established by a member to protect their confidentiality and match with the ID.

  1. Article 3: Membership Registration

  2. Service agreements are established when an individual agrees to the terms, fills out the required form with member information (phone number, password, and other necessary details as deemed by Lottery Stupore), and clicks the "Confirm" button. The agreement becomes active once Lottery Stupore approves it.

  3. Members must provide accurate personal details as requested by Lottery Stupore.

  4. Lottery Stupore will manage and may request your phone number ID and password during service use.

  5. Each member is allowed only one ID.

  6. Membership may be denied or revoked for the following reasons:

  7. Use of another person’s identity.

  8. False or intentionally omitted information.

  9. Registrants below 19 years of age. However, actions taken after reaching 19 years of age will be recognized.

  10. If membership has been previously cancelled under these terms.

  11. Misuse of Lottery Stupore against laws or public order.

  1. Article 4: Use of Service

  2. Services are available 24/7, unless there are operational or technical interruptions.

  3. Refunds or cancellations are possible for tickets purchased between 12:01 AM and 6:30 PM the same day.

  4. Due to the nature of lotteries, cancellations after 6:30 PM are not possible.

  5. Members can choose between lump sum or installment payments for lottery winnings. Details are available on the website.

  6. Lottery purchase details can be verified on the site. Winning details can be checked via email or the site.

  7. When purchasing a lottery ticket, members pay both the actual ticket price and a service fee.

  8. Tickets owned by members who lose rights or withdraw will automatically belong to Lottery Stupore.

  9. Lottery Stupore is not responsible for purchases not made due to unforeseen events.

  1. Article 5: Fees and Costs

  2. A 10% fee is applied to first and second-place winnings.

  3. Members pay a service fee for website use, scanning, email notifications, and other associated services.

  4. For large winnings, prizes are processed in the name of Lottery Stupore at local outlets.

  5. Any fees or costs for claiming the prize will be deducted from the winnings.

Article 6 (Service Interruption)
Lottery Stupore may temporarily suspend its services in the event of computer or communication equipment maintenance, replacement, malfunction, communication disruption, natural disasters, war, riots, insurrections, or other uncontrollable circumstances. If the service is interrupted due to the reasons mentioned in the preceding clause, Lottery Stupore will notify its members via site announcements or through methods such as email or phone. Lottery Stupore will not be responsible for any damages incurred by members due to these service interruptions. If Lottery Stupore needs to permanently or temporarily suspend its service due to business decisions, efforts will be made to transfer the service or points to a similar business entity. If unavoidable, refunds will be made, and the service can be permanently or temporarily suspended after prior notice.

Article 7 (Point Recharge)
Members can recharge their points through various services provided by Lottery Stupore and to pay for lottery ticket purchases via credit card, interbank payment, or other third-party payment methods specified by Lottery Stupore. The applicable exchange rate will be set by Lottery Stupore, referencing the rate provided by the transaction bank. When transferring prize money to customers, it will be processed according to the exchange rate specified by Lottery Stupore.

Article 9 (Prize Money Payment Regulations)
Lottery prize amounts and tax deductions are applied based on the regulations of the respective country's lottery agency. If the prize money is less than US$600, it will be automatically charged to the member's mileage. For prize amounts of US$600 or more where taxes are applicable, the amount after tax deduction will be credited to mileage. This may take up to a week. Upon purchase, the physical lottery ticket belongs to the member. For 1st and 2nd prize winners, the procedure for receiving the prize money will be carried out in consultation with the local branch, following the lottery laws and the state laws of Washington. The winner must have the same registered member name and personal information; if the member's name or payment information is incorrect, and accurate proof or ID is not provided, the prize money may be denied.

Article 10 (Lottery Ticket Storage)
The physical lottery ticket is primarily stored by Lottery Stupore. However, 1st prize-winning physical lottery tickets can be stored in the vault of Lottery Stupore's main transacting bank. Each lottery ticket, based on its draw, will be stored as a physical non-winning ticket for 2 weeks, and a scanned version of the non-winning ticket will be stored for 1 month.

Article 11 (Lottery Purchase)

Lottery Stupore (hereinafter referred to as “the Company”) will purchase lottery numbers as requested by the member. The Company bears no responsibility for any unintended number purchases due to a member's error.

In the case of selective automatic lottery purchases, the Company is not responsible if a purchase is not made due to insufficient member mileage.

If a member's requested numbers are not purchased due to printing and system errors, the Company is not liable unless intentional. Members must always verify their order number after order completion. In cases of incorrect purchases, members can request repurchase. For repurchase requests, the Company must promptly process them. Both the correctly processed lottery and the mistakenly purchased lottery are owned by the member. If repurchase is not possible due to official lottery sales closing, the original order is refunded, and the mistakenly purchased lottery remains the member's property.

Article 12 (Contract Termination and Usage Restrictions)

Members wishing to terminate their membership contract can request Lottery Stupore to do so, and the Company will process this request immediately upon receiving.

If a member acts in violation of Article 14, Section 2 and Article 17, Section 2, the Company can restrict, suspend, or revoke their membership in an appropriate manner. Furthermore, the member will be held responsible for any resulting damages.

In the following circumstances, the Company can immediately invalidate or suspend all actions of a member, revoke their membership rights, and report to relevant authorities when necessary:

  1. Using another person's credit card. However, if no objections regarding illegal card usage arise from the cardholder within a certain period, it is considered legal usage.

  2. Using an illegal card.

  3. Repeated credit card input failures leading the Company to suspect credit card hacking.

  4. Repeated attempts and failures of ID and password input leading the Company to suspect ID hacking. To prevent fraud, the Company monitors users' ID and IP addresses. This is not surveillance but for damage prevention.

Members re-registering after withdrawal are treated as new members. However, if they register with the same information, previous transaction records or data might appear duplicated, and re-registration with the same ID due to security concerns is not allowed.

If the Company intends to restrict a member's usage, it will notify the member of the reasons, timing, and duration via email, in writing, or by phone. However, if the Company deems it essential to urgently suspend usage, this notification process might be skipped.

Members with un-drawn lotteries can only withdraw after the lottery draw is completed. If members withdraw, rights to their purchased lottery are also instantly nullified.

Before withdrawing, members must apply for mileage refund. If members withdraw without applying for a point refund, their points will automatically expire, and recovery is not possible.

If a member shows no activity such as point recharges and purchase records for six months after registration, or if there's inactivity for one year after their last purchase, their membership can be revoked. In such cases, they will be notified via their registered email. To use the site again, they must re-register.

Ordering foreign lottery tickets is prohibited in regions where it's not legally permitted. Customers are advised to refer to the laws of their respective regions.

Article 13 (Duties of Lottery Stupore)

  1. Unless under special circumstances, Lottery Stupore ensures that members can use the services they apply for.

  2. Lottery Stupore must not disclose or distribute a member's personal information to third parties without the member's consent. However, this does not apply when required by related U.S. laws or government agencies.

  3. If a member raises a concern or complaint that is deemed legitimate by Lottery Stupore, it will be promptly addressed. If immediate action is not possible, the reason and expected timeline for resolution will be communicated to the member.

  4. To publicly announce a member's winning status through external media, personal privacy details such as photos and personal information will be kept confidential, and the winner's prior permission will be sought.

Article 14 (Duties of the Member)

  1. Membership registration is only for individuals 19 years or older (or considered an adult by their national law), and personal information must be accurately provided upon registration.

  2. Members may lose their membership privileges for the following actions:

    • Unauthorized use of another member's ID, password, or personal identification number.

    • Modifying or distributing information posted on Lottery Stupore.

    • Infringing on the copyrights, portrait rights, or other intellectual property rights of Lottery Stupore or any third party.

    • Defaming or disrupting the operations of Lottery Stupore or any third party.

    • Disseminating or posting obscene, violent, or inappropriate messages, images, or sounds on Lottery Stupore.

    • Impersonating Lottery Stupore staff, administrators, or associates.

    • Transferring, selling, or buying a member ID.

    • Exploiting bugs in the Lottery Stupore program.

    • Illegally obtaining cyber assets such as virtual currency or items.

    • Intentionally damaging or disrupting the service.

    • Conducting business operations on Lottery Stupore without prior permission.

    • Harassing, threatening, or continually causing distress or inconvenience to other members.

    • Engaging in activities objectively deemed to be criminal.

    • Collecting or storing personal information of other members without Lottery Stupore's consent.

    • Violating any laws or regulations.

  3. The responsibility for managing member ID and passwords lies solely with the member. Members must not lend, transfer, or engage in similar actions with their ID or password. Any issues arising from negligence, unauthorized use, or misuse of ID and password are the member's responsibility.

  4. If a member's ID is used without authorization, they must immediately change their password and notify Lottery Stupore.

  5. Members must update their contact details and other personal information on the platform or inform Lottery Stupore immediately if there are any changes.

  6. Members cannot transfer or gift their service access rights or any contractual position to another individual without the prior consent of Lottery Stupore.

  7. By registering as a member, it is presumed that the member consents to receiving necessary advertisements or information related to the service through SMS, email, or other means. Members can later change their email reception preferences via the information change section.

Article 15 (Rights of Lottery Stupore)

  1. If a member's personal details are falsely provided or unauthorized during registration, or if the member's identity is not confirmed until one day before the final deadline after a lottery draw, the payment of winnings may be denied. However, the winner must prove their identity at any time after the draw.

  2. If a member's privileges are revoked as per Articles 14 and 17, the right to claim any winnings will also be revoked simultaneously.

  3. If a winner passes away, the legal heirs inherit the same rights to the lottery ticket.

Article 16 (Dispute Resolution)

  1. If members have concerns or queries regarding their lottery purchase or any service, they can raise a dispute at any time.

  2. Lottery Stupore may temporarily suspend the use of services for the duration of a dispute investigation. The results of the investigation will be communicated to the member.

  3. Lottery Stupore will address a member's dispute immediately. If this is not possible, the member will be informed of the reason.

  4. If an error is found in a member's claim, Lottery Stupore will rectify it immediately and compensate the member through a fair procedure.

  5. If the reason for a service suspension is resolved during the suspension period, the suspension will be lifted immediately.

Article 17 (Compensation for Damages) Lottery Stupore, in providing its services, is liable for compensation if it fails to provide complete service due to its own fault. Lottery Stupore may seek damages from members for intentional hacking, disruption of operations, or delays in service caused by the member.

Article 18 (Disclaimer) Lottery Stupore shall not be liable for any damages caused to members in the following cases:

  1. Inability to provide or delay in providing the service due to issues with communication devices, lines, computers, or an overwhelming volume of transactions.

  2. Temporary discontinuation of the service due to unavoidable reasons such as equipment maintenance, replacement, regular inspection, and construction.

  3. Members disclosing their MemberID, password, etc. to third parties due to their own negligence.

  4. Disruptions in service due to uncontrollable circumstances such as service interruptions by US telecommunication providers or other unforeseeable events. Lottery Stupore is not liable for any expected profits members might lose using the service, nor for damages arising from data obtained through the service. Lottery Stupore is not responsible for the reliability or accuracy of the information, materials, or facts posted by members on the service.

Article 19 (Jurisdiction and Governing Law) For electronic transaction disputes arising between Lottery Stupore and members, both US law and Korean law will be simultaneously applied.

​

Article 20 (Effectiveness) These terms and conditions come into effect immediately upon being posted on the service, board, or through other means. Lottery Stupore has the right to change these terms and conditions, and the modified terms will come into effect as per the previous clause. Matters not specified in these terms and interpretations thereof will be governed by related laws or customary business practices.
